YOUTHORITY BRAND EVOLUTION COMPETITION
OFFICIAL TERMS AND CONDITIONS
Promoter: Youthority Pty Ltd (ABN 69 681 973 571) of 9A Hallstrom Place, Mona Vale NSW 2103 (“Youthority”, “we”, “us”, “our”)
Competition Period: Opens 1st November 2025 at 12pm AEDT and closes 28th November 2025 at 12pm AEDT (“Competition Period”)
1. ELIGIBILITY
1.1 Entry is open to individuals who:
- Are aged between 13-24 years at the time of entry
- Are Australian residents
- Have a valid TikTok account
- For entrants aged 13-17 years:
- A parent or legal guardian must submit the entry on the minor’s behalf and accept these Terms and Conditions
1.2 The following persons are not eligible to enter:
- Employees, contractors, or immediate family members of Youthority Pty Ltd
- Professional branding agencies or businesses (entries must be from individuals)
- Anyone who has previously won a Youthority competition in the last 12 months
1.3 “Immediate family members” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent).
2. HOW TO ENTER
2.1 To enter, you must:
a) Follow Youthority’s official TikTok account [@youthority]
b) Tag 3 friends in the competition announcement post
c) Submit your entry via the custom landing page at weareyouthority.com including:
- Brand Board
- Logo refresh/reinterpretation (keeping “Kon-X” recognisable)
- Colour palette options
- Font pairing (primary + secondary)
- Mood board showing inspiration
d) Complete the online entry form with:
- First name
- Age
- Email address (over 18)
- TikTok handle
- State/Territory of residence
- For entrants aged 13-17:
- Parent/guardian full name, email,
e) Accept these Terms and Conditions
2.2 Entries may be submitted using any creative medium including digital design tools (Canva, Adobe, etc.), hand-drawn designs photographed/scanned, collages, or video presentations.
2.3 One entry per person only. Multiple entries from the same person will result in disqualification of all entries from that person.
2.4 Entries must be received during the Competition Period. Entries received outside this period will not be accepted.
2.5 Entries must be submitted in English.
3. ENTRY REQUIREMENTS & ORIGINALITY
3.1 All entries must be:
- Original work created by the entrant
- Free from any third-party intellectual property rights
- Not previously published or submitted to other competitions
- Appropriate for all audiences (no offensive, defamatory, or inappropriate content)
3.2 Copyright and Trademark Compliance:
a) Entrants must ensure their submission does not infringe any third-party intellectual property rights including copyright, trademarks, or design rights.
b) Entrants must not copy, reproduce, or substantially imitate existing logos, designs, or branding from other sources.
c) If inspiration is drawn from existing work, it must be transformative and original, with sources credited in the mood board.
d) Verification: Entrants are responsible for checking that their designs do not infringe existing intellectual property. You can search for existing trademarks at: https://www.ipaustralia.gov.au/trade-marks
3.3 Consequences of Copyright Infringement:
- If an entry is found to infringe third-party intellectual property rights (either before or after winner announcement):
- The entry will be immediately disqualified
- Any prize awarded will not be paid or must be returned
- The entrant may face legal consequences from the intellectual property owner
- Youthority reserves the right to pursue legal action for any damages suffered
3.4 By entering, you warrant that:
- You are the sole creator and owner of the entry
- Your entry is original and does not infringe any third-party rights
- You have obtained all necessary permissions for any elements included in your entry
- All information provided in your entry is true and accurate
- Your entry may been shown on Youthority’s platforms during the competition
4. SELECTION PROCESS
4.1 The competition will be conducted in two stages:
STAGE 1: JUDGING PANEL SELECTION (Skill-Based)
a) All eligible entries will be reviewed by a judging panel appointed by Youthority.
b) The judging panel will select the Top 5 finalists based on the following criteria:
- Creativity & Originality (30%)
- Brand Alignment (25%)
- Visual Appeal & Design Quality (25%)
- Feasibility & Practical Application (20%)
c) Judging will take place between 29th November 2025 and 30th November 2025
d) The Top 5 finalists will be notified via email and TikTok direct message on 30th November
STAGE 2: PUBLIC VOTING (Community Choice)
e) The Top 5 finalist entries will be showcased on Youthority’s TikTok account between 1st December 2025 and 5th December 2025 (“Voting Period”).
f) Each finalist will be credited by name/TikTok handle in their showcase post.
g) The TikTok community will vote for their favourite entry by commenting with a specific keyword announced on our socials e.g. WINNER.
h) The entry with the highest number of votes at the end of the Voting Period will be declared the Grand Prize Winner.
i) In the event of a tie, the judging panel will select the winner from the tied entries based on the original judging criteria.
4.2 The Promoter’s decision is final, and no correspondence will be entered into.
4.3 Finalists and the winner will be announced on Youthority’s TikTok account on 6th December.
5. PRIZES
5.1 GRAND PRIZE (1 Winner):
- A$1,000 cash (paid via bank transfer or PayPal within 30 days of winner verification)
- Prominent brand credit: “Brand evolved by [Winner Name]” displayed on Youthority’s website
- Official Winner Certificate (digital)
- Social media feature across Youthority’s platforms
- 3 months free access to Youthority platform/services (valued at $44.85)
5.2 RUNNERS-UP PRIZES (4 Finalists):
- Official Finalist Certificate (digital)
- Social media feature on Youthority’s TikTok account
- 3 months free access to Youthority platform/services (valued at $44.85)
5.3 Total prize pool value: A$1,089.70.
5.4 Prizes are not transferable, exchangeable, or redeemable for cash (except the cash component of the Grand Prize).
5.5 If a winner is under 18 years of age, the prize will be awarded to their parent or legal guardian on their behalf.
5.6 The Promoter accepts no responsibility for any tax implications arising from prize winnings. Winners should seek independent financial advice.
5.7 If a prize (or element of a prize) is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value.
6. WINNER NOTIFICATION & VERIFICATION
6.1 The Grand Prize Winner will be notified via:
- Email to the address provided in their entry
- TikTok direct message
- Public announcement on Youthority’s TikTok account
6.2 The winner must respond within 7 days of notification to claim their prize. If the winner does not respond within this timeframe, the prize will be forfeited and awarded to the entry with the next highest number of votes.
6.3 Before receiving the prize, the winner must:
- Provide proof of identity and age (driver’s license, passport, or birth certificate)
- Provide bank account details or PayPal information for cash prize payment
- Sign a Winner Declaration and Release Form
- If under 18: Parent/guardian must sign all documentation on their behalf
6.4 The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entry that:
- Is not in accordance with these Terms and Conditions
- Contains fraudulent or misleading information
- Infringes third-party intellectual property rights
- Is deemed inappropriate or offensive
7. INTELLECTUAL PROPERTY RIGHTS
7.1 GRAND PRIZE WINNER:
a) By accepting the Grand Prize, the winner assigns all intellectual property rights (including copyright, design rights, and moral rights) in their entry to Youthority Pty Ltd.
b) This assignment includes the right for Youthority to:
- Use, reproduce, modify, and adapt the winning design
- Implement the design across all Youthority branding and marketing materials
- Register any trademarks or design rights in the winning design
- Create derivative works based on the winning design
- Use the design in perpetuity without further compensation
c) Creative Adaptation Rights: The winner acknowledges and agrees that Youthority may exercise creative licensing over the winning design to ensure it aligns with the Kon-X brand identity and operational requirements. This includes the right to:
- Refine, adjust, or modify design elements (including colours, typography, proportions, and layout)
- Adapt the design for different applications and media formats
- Collaborate with professional designers to implement the winning concept
- Make technical adjustments for production and digital implementation
- Evolve the design over time to meet changing business needs
d) Youthority commits to maintaining the core essence and creative vision of the winning entry when exercising these adaptation rights, ensuring the winner’s original concept remains recognizable and their contribution is honoured.
e) The winner consents to Youthority being identified as the owner of the design and waives all moral rights in the work to the extent permitted by law, while understanding that reasonable adaptations may be necessary for practical implementation.
f) The winner will receive brand credit as “Brand evolved by [Winner Name]” on Youthority’s website and app, regardless of any adaptations made to the original design.
7.2 TOP 5 FINALISTS (excluding winner):
a) Finalists retain full ownership and intellectual property rights in their entries.
b) Finalists grant Youthority a limited, non-exclusive, royalty-free license to:
- Display their entry on TikTok and other social media platforms for promotional purposes
- Use their entry in competition-related marketing materials
- Credit the finalist by name/TikTok handle when showcasing their work
c) This license is valid for 12 months from the competition close date, after which Youthority will cease using the finalist’s work unless separate permission is obtained.
d) Finalists may request removal of their work from Youthority’s platforms at any time by emailing support@weareyouthority.com
7.3 NON-FINALIST ENTRIES:
a) All other entrants retain full ownership and intellectual property rights in their entries.
b) Youthority will not use, reproduce, or display non-finalist entries without express written permission.
c) Non-finalist entries may be deleted from Youthority’s systems after 90 days from the competition close date.
7.4 By entering, all entrants consent to Youthority using their name, TikTok handle, likeness, and entry for promotional purposes related to this competition without further compensation.
8. PRIVACY & DATA COLLECTION
8.1 Personal information collected during this competition will be used for the purposes of:
- Administering the competition
- Verifying entrant eligibility
- Contacting finalists and winners
- Delivering prizes
- Promotional purposes related to the competition
8.2 By entering, you consent to Youthority collecting, using, and disclosing your personal information in accordance with our Privacy Policy available at [INSERT PRIVACY POLICY URL].
8.3 For entrants aged 13-15 years, the parent/guardian consents to the collection and use of the minor’s personal information as described in these Terms.
8.4 Personal information may be disclosed to third parties including:
- Prize suppliers and delivery partners
- Social media platforms (TikTok)
- Professional advisors and service providers
8.5 You may request access to or correction of your personal information by contacting support@weareyouthority.com
8.6 Youthority will handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
9. CONTENT & PUBLICITY
9.1 By entering, you consent to:
- Your entry being displayed publicly on TikTok and other Youthority platforms
- Your name, TikTok handle, age (or age range), and state of residence being published
- Participating in promotional activities if selected as a finalist or winner (including interviews, photos, videos)
9.2 Entrants aged 13-15: The parent/guardian consents to the minor’s participation in promotional activities and use of their name, image, and work.
9.3 You will not be entitled to any fee or compensation for promotional use beyond the prizes specified in these Terms.
9.4 All entries must comply with TikTok’s Community Guidelines and Terms of Service.
10. LIABILITY & INDEMNITY
10.1 To the extent permitted by law, Youthority (including its officers, employees, and agents) excludes all liability for any loss, damage, or injury suffered in connection with:
- Participation in this competition
- Use of any prize
- Technical difficulties or malfunctions
- Unauthorized access to or alteration of entries
- Late, lost, misdirected, or incomplete entries
10.2 Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded.
10.3 By entering, you indemnify and hold harmless Youthority from any claims, damages, or expenses arising from:
- Your breach of these Terms and Conditions
- Your infringement of third-party intellectual property rights
- Any false or misleading information provided in your entry
- Your violation of any applicable laws
10.4 Youthority is not responsible for:
- Any disputes between entrants
- Comments or interactions on social media platforms
- Technical issues with TikTok or the entry submission platform
- Internet or network connectivity problems
11. DISQUALIFICATION
11.1 Youthority reserves the right to disqualify any entry or entrant who:
- Breaches these Terms and Conditions
- Provides false or misleading information
- Engages in fraudulent or dishonest conduct
- Manipulates the voting process or entry mechanism
- Submits offensive, inappropriate, or unlawful content
- Infringes third-party intellectual property rights
- Tampers with the competition process
- Acts in a manner that is disruptive or harmful to the competition
11.2 Disqualified entrants forfeit all rights to any prizes.
12. GENERAL CONDITIONS
12.1 Youthority reserves the right to:
- Verify the validity and eligibility of entries
- Request additional information or documentation from entrants
- Modify, suspend, or cancel the competition if circumstances arise beyond its reasonable control
- Disqualify entries that do not comply with these Terms
12.2 If the competition is interfered with in any way or cannot be conducted as planned due to circumstances beyond Youthority’s control (including technical failures, natural disasters, or government restrictions), Youthority reserves the right to:
- Cancel, terminate, modify, or suspend the competition
- Select winners from eligible entries received up to the time of cancellation/suspension
12.3 Failure by Youthority to enforce any of its rights does not constitute a waiver of those rights.
12.4 These Terms and Conditions are governed by the laws of New South Wales, Australia. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
12.5 If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
12.6 Entry into this competition is deemed acceptance of these Terms and Conditions.
