1.1 Youthority Pty Ltd (“Youthority”, “we”, “us”, “our”) is committed to protecting the privacy of individuals who enter the Youthority Brand Evolution Competition (“Competition”).

1.2 This Privacy Policy explains how we collect, use, store, disclose, and protect personal information in connection with the Competition, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1.3 By entering the Competition, you (or your parent/guardian if you are aged 13-17) consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

1.4 This Privacy Policy should be read in conjunction with the Competition Terms and Conditions.

2. WHAT PERSONAL INFORMATION WE COLLECT

2.1 We collect the following personal information when you enter the Competition:

For All Entrants:

  • First name, Age, Email address (18-24 years), TikTok handle/username, State/Territory of residence, Creative work submissions (Brand Board, logo designs, colour palettes, font pairings, mood boards)
  • For Entrants Aged 13-17: 
    • Parent/guardian full name, Parent/guardian email address, Relationship of parent/guardian to entrant
  • For Finalists and Winners: 
    • Proof of identity documents (driver’s license, passport, or birth certificate), Bank account details or PayPal information (for prize payment), Photographs, videos, or interview content (if participating in promotional activities)

2.2 We may also collect technical information through our website, including: IP address, Browser type and version, Device information, Pages visited and time spent on pages, Referring website addresses, Analytics data collected via Google Analytics (see Section 4 below)

3. HOW WE COLLECT PERSONAL INFORMATION

3.1 We collect personal information directly from you (or your parent/guardian) when you:

  • Submit an entry via the competition landing page at weareyouthority.com 
  • Complete the online entry form using Forminator
  • Interact with our TikTok account (following, tagging, commenting)
  • Respond to winner notification emails or messages
  • Provide additional documentation for prize verification
  • Participate in promotional activities

3.2 We may collect information from third parties including:

  • TikTok (to verify account existence and engagement with competition posts)
  • Payment processors (for prize distribution)

3.3 We collect information automatically through:

  • Google Analytics on our competition landing page
  • Cookies and similar tracking technologies (see Section 4 below)

4. COOKIES AND TRACKING TECHNOLOGIES

4.1 Our competition landing page uses cookies and similar tracking technologies to enhance user experience and collect analytics data.

4.2 Google Analytics:

  • We use Google Analytics to understand how visitors interact with our competition landing page
  • Google Analytics collects information such as pages visited, time spent on site, browser type, and device information
  • This data is aggregated and anonymized

5. HOW WE USE YOUR PERSONAL INFORMATION

5.1 We use your personal information for the following purposes:

Competition Administration:

  • Processing and managing competition entries
  • Verifying eligibility of entrants
  • Conducting the judging process
  • Selecting finalists and winners
  • Contacting finalists and winners
  • Delivering prizes
  • Responding to enquiries about the Competition

Legal Compliance:

  • Complying with legal obligations under Australian law
  • Verifying identity and age of entrants
  • Maintaining records for regulatory purposes
  • Preventing fraud and protecting against illegal activities

Promotional Purposes:

  • Displaying finalist entries on TikTok and other social media platforms
  • Publishing names, TikTok handles, and age ranges of finalists and winners
  • Creating promotional content featuring finalists and winners
  • Announcing competition results

Marketing Communications (With Consent Only):

  • If you provide separate consent, we may add your email address to our marketing list
  • You will receive updates about Youthority products, services, and future competitions
  • You can unsubscribe from marketing communications at any time (see Section 11)

Website Analytics:

  • Understanding how visitors use our competition landing page

  • Analyzing traffic patterns and engagement metrics

5.2 We will only use your personal information for the purposes for which it was collected, or for related purposes that you would reasonably expect.

6. DISCLOSURE OF PERSONAL INFORMATION

  • Forminator (form submission and data collection)
  • Google Analytics (website analytics)
  • Email service providers (for communications)

  • TikTok (when we publish finalist entries and winner announcements)
  • Other social media platforms where we promote the Competition

  • Law enforcement agencies, courts, or government authorities if required by law

6.2 We will NOT:

  • Share your personal information with sponsors or partners without your explicit consent
  • Disclose your personal information for purposes unrelated to the Competition

7.2 Our security measures include:

7.4 If we become aware of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by law.

8. DATA RETENTION

8.1 We retain personal information for different periods depending on your status in the Competition:

Non-Finalists:

  • Personal information will be retained for 90 days after the Competition close date
  • After 90 days, all personal information and entry submissions will be permanently deleted from our system
  • Exception: If you have separately consented to marketing communications, your email address will be retained on our marketing list until you unsubscribe

Top 5 Finalists (excluding winner):

  • Personal information will be retained for 12 months after the Competition close date
  • Entry submissions may be displayed on our platforms during this period (as per the limited license granted in the Terms and Conditions)
  • After 12 months, personal information will be deleted unless you request earlier removal

Grand Prize Winner:

  • Personal information will be retained for 7 years after the Competition close date for tax, legal, and accounting purposes
  • The winning design and associated intellectual property will be retained indefinitely (as ownership transfers to Youthority)

8.2 If you request deletion of your personal information (see Section 10), we will comply unless we are required to retain it by law.

8.3 Personal information may be retained longer if required for legal proceedings, regulatory investigations, or to establish, exercise, or defend legal claims.

9. OVERSEAS DISCLOSURE

9.1 Some of our service providers may store or process personal information outside Australia, including:

  • United States: Google Analytics, cloud storage providers, payment processors
  • Other jurisdictions: Where our service providers operate servers or data centres

9.2 When we disclose personal information to overseas recipients, we take reasonable steps to ensure they comply with Australian privacy laws or are subject to substantially similar privacy protections.

9.3 By entering the Competition, you consent to the disclosure of your personal information to overseas recipients for the purposes described in this Privacy Policy.

10. YOUR RIGHTS AND CHOICES

10.1 Under Australian privacy law, you have the following rights:

Access:

  • We will provide access within a reasonable timeframe (usually 30 days)

  • Withdrawal of consent will result in disqualification from the Competition

10.2 For Finalists:

  • You (or your parent/guardian if aged 13-17) can request removal of your entry from our platforms at any time by emailing support@weareyouthority.com
  • We will remove your entry within 7 business days of receiving your request

10.3 To exercise any of these rights, please contact us using the details in Section 13

11. MARKETING COMMUNICATIONS

11.1 Separate Consent Required:

  • Entry into the Competition does NOT automatically subscribe you to marketing communications
  • During the entry process, you will be asked separately whether you wish to receive marketing communications from Youthority
  • Marketing consent is entirely optional and does not affect your Competition entry

11.2 What We Send:

  • If you consent to marketing communications, we may send you:
  • Updates about Youthority products and services
  • Information about future competitions and events
  • News, tips, and content related to youth empowerment and branding
  • Special offers and promotions

11.3 Unsubscribing:

  • You can unsubscribe from marketing communications at any time by:
  • Clicking the “unsubscribe” link in any marketing email
  • Emailing us at support@weareyouthority.com  with “Unsubscribe” in the subject line
  • Contacting us using the details in Section 13
  • We will process your unsubscribe request within 5 business days
  • Unsubscribing from marketing will not affect Competition-related communications (e.g., winner notifications)

11.4 For Entrants Aged 13-17:

  • If a parent/guardian provides consent for marketing communications on behalf of a minor, either the parent/guardian or the minor (once they turn 18) can unsubscribe at any time

12. COMPLAINTS AND DISPUTES

12.1 If you have a complaint about how we have handled your personal information, please contact us first using the details in Section 13.

12.2 Your complaint should include:

  • Your name and contact details
  • Details of your complaint
  • Any relevant supporting information
  • Your preferred outcome or resolution

12.3 We will:

  • Acknowledge your complaint within 7 business days
  • Investigate your complaint thoroughly
  • Respond to your complaint within 30 days
  • Provide reasons for our decision and any actions we will take

14.3 If we make significant changes that materially affect how we handle your personal information, we will notify you by:

  • Email (if we have your email address)
  • Prominent notice on our website
  • TikTok announcement

14.4 Your continued participation in the Competition after changes are posted constitutes acceptance of the updated Privacy Policy.

15. CHILDREN’S PRIVACY

15.1 We recognize the importance of protecting the privacy of children and young people.

15.2 For Entrants Aged 13-17:

  • We require a parent or legal guardian to submit the entry on behalf of the minor
  • The parent/guardian must consent to this Privacy Policy
  • The parent/guardian is responsible for ensuring the minor understands how their information will be used
  • The parent/guardian can exercise all privacy rights on behalf of the minor

15.3 We collect only the minimum personal information necessary to administer the Competition for entrants aged 13-17.

15.4 We do not knowingly collect personal information from children under 13 years of age. If we become aware that we have inadvertently collected information from a child under 13, we will delete it immediately.

15.5 Parents/guardians can contact us at any time to:

  • Review the personal information we hold about their child
  • Request correction or deletion of their child’s information
  • Withdraw consent for their child’s participation (resulting in disqualification)

16. LINKS TO THIRD-PARTY WEBSITES

16.1 Our competition landing page or social media posts may contain links to third-party websites, including:

  • TikTok
  • Instagram
  • Other social media platforms
  • Partner websites

16.2 This Privacy Policy applies only to personal information collected by Youthority in connection with the Competition.

16.3 We are not responsible for the privacy practices of third-party websites. We encourage you to review the privacy policies of any third-party websites you visit.

16.4 When you interact with our Competition on TikTok or other social media platforms, those platforms’ privacy policies and terms of service also apply.

17. AUSTRALIAN PRIVACY PRINCIPLES COMPLIANCE

17.1 This Privacy Policy and our practices comply with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

17.2 We are committed to:

  • APP 1: Open and transparent management of personal information
  • APP 2: Anonymity and pseudonymity where practicable (noting that Competition entry requires identification)

18. ACKNOWLEDGMENT AND CONSENT

18.1 By entering the Competition, you acknowledge that:

  • You have read and understood this Privacy Policy
  • You consent to the collection, use, disclosure, and storage of your personal information as described in this Privacy Policy
  • If you are aged 13-17, your parent/guardian has read, understood, and consented to this Privacy Policy on your behalf

18.2 If you do not agree with this Privacy Policy, you should not enter the Competition.
